Verdict in arson and public disorder case

A mixed panel of judges, presided over by a EULEX judge at the District Court of Prizren, on 10 February 2012, sentenced E.H. to two years of imprisonment and ordered him to pay two thousand euros.

E.H., was charged by the prosecution on four counts: Inciting national, racial, religious or ethnic hatred, discord or intolerance; Causing general danger resulting in sizeable property loss; Causing general danger in a place where a large number of people were gathered, resulting in substantial material damage; and Participation in a crowd.

On 18 March 2004, the defendant E.H. committed arson and publicly spread hatred, discord or intolerance against the Serbian ethnic group living in Kosovo. A day earlier, he also set fire to some UNMIK vehicles.

The prison sentence is suspended and shall only apply if the defendant commits a new criminal offence in the next five years. The verdict is not appealable due to the plea agreement made by the parties.

The indictment was filed on 21 March 2006. The case was prosecuted by a EULEX prosecutor from Prizren District.
