Supreme Court upholds punishment in narcotics case

3 September 2012

A mixed panel of two EULEX judges and three local judges, presided over by a EULEX judge at the Supreme Court rejected all the appeals as ungrounded in the case against Anton Syla, Vilson Dreni, Driton Syla and Antal Varga sentenced by the District Court of Prishtinë/Priština for unauthorized purchase, possession, distribution and sale of dangerous narcotic substances in co-perpetration and unauthorized ownership, control, possession and use of weapons.

The panel also modified the first instance verdict by re-qualifying the criminal offence. The remaining part of the first instance judgment – including the punishments – was left unchanged. The Supreme Court panel upheld detention on remand for the four defendants arguing that the reasons for detention continue to exist.

The case against Anton Syla, Vilson Dreni, Driton Syla and Antal Varga is related to the confiscation of about 89.5 kg of marijuana in April 2010 and several firearms and ammunition kept without necessary authorizations.

The case was prosecuted by a local district prosecutor from the Office of the State Prosecutor of Kosovo.
