Charges rejected in narcotics case

A mixed panel of two EULEX judges and one local judge at the District Court of Prizren on 23 May 2012 rejected all the charges against Shefki Kajserli, Necat Mazrek, Mentor Seferaj and Avdullah Ramadanaj.

The court concluded that the initial file presented by the prosecution did not contain all the relevant facts. Due to the fact that that vital information was missing, the trial panel could not verify whether the police had been operating according to the rules for criminal proceedings. Therefore the court concluded that the prosecutor has lost his right to prosecute and prosecution therefore is barred.

Kajserli, Seferaj and Ramadanaj were charged with the criminal offence of unauthorized possession of dangerous narcotic substances. Mazreku was charged with the criminal offences of unauthorized possession of dangerous narcotic substances and unauthorized ownership, control, possession or use of weapons.

The case was prosecuted by a local prosecutor from the Special Prosecution Office of Kosovo.
