The Special Chamber of the Supreme Court of Kosovo on Kosovo Trust Agency Related Matters

The Special Chamber of the Supreme Court of Kosovo on KTA Related Matters (SCSC) was established by UNMIK in 2003 as an international court to provide for a strong, independent and unbiased control mechanism for the privatization process in Kosovo, carried out by the Kosovo Trust Agency (KTA). EULEX has currently deployed 30 staff to the SCSC.

The legal basis for the establishment of the SCSC in its present form is UNMIK Regulation 2008/4 together with UNMIK Administrative Direction 2008/6. EULEX judges in the SCSC have executive functions – the law prescribes that there is always a majority of EULEX judges on each panel; EULEX judges in the SCSC are not engaged in MMA activities.

The SCSC is adjudicating a large number of cases, ca. 600 regular claims in the first and second instance and ca. 2700 complaints in so called ‘employee list cases’, and aims at tackling this current and the future caseload, despite facing logistical obstacles (e.g. shortage of international and local judges, lack of premises, unclear legal framework).

Additional rules and directions of the President were passed in Albanian, Serbian and English language; in case of conflict the English versions prevail. The same applies to all decisions, judgments and orders passed by the SCSC.
