Supreme Court Dismisses the Requests for the Protection of Legality

On 8 March 2016 the Supreme Court, in a mixed Panel of two international Judges and one local Judge, deliberated on two Requests for Protection of Legality.

The defendants, with 4 other co-defendants, have been found guilty of the criminal offence of Abusing Official Position or Authority by the Basic Court of Prizren on 13 March 2014.  All defendants appealed against their conviction, and on 22 July 2015 the Court of Appeals granted the appeals, annulled the Judgment of the Basic Court of Prizren and returned the case for a retrial. The State Prosecutor appealed to the Supreme Court against the decision of the Court of Appeals, and on 1 December 2015 the Supreme Court granted the appeal and returned the case to the Court of Appeals for reconsideration by a new Panel.  Requests for Protection of Legality against this decision were filed by two of the defendants in this case.

The Supreme Court dismissed the Requests for Protection of Legality by the defendants as inadmissible.  Therefore the case will be returned to the Court of Appeals for reconsideration by a new Panel in accordance with the Supreme Court decision of 1 December 2015.
