Supreme Court Returns KEK Case to Main Trial

The SPRK filed an indictment last January against 7 defendants for alleged corruption involving the public utility company, Kosovo Energy Corporation, KEK. The indictment alleges various criminal offences of fraud, falsifying documents, abuse of official position of authority and entering harmful contracts. 

On 11 June 2015, the first instance court rejected as ungrounded the objections of the defence counsels concerning the evidence and request to dismiss the indictment. The Court also confirmed the indictment. On 5 August, the Court of Appeals partially granted the defence counsels’ appeals and dismissed the indictment as belated.

On 26 November 2015, a mixed panel of judges of the Supreme Court of Kosovo, overruled the Court of Appeal and approved the request for protection of legality filed by the Office of State Prosecutor.  The Court amended the decision of the Court of Appeals which had declared the indictment as belated. The case is returned to the Basic Court of Pristina to proceed with the main trial accordingly.
